You are responsible for configuring your information technology, computer programs, and platform to access the services, and you shall use your own anti - virus software.

You shall not abuse the services by intentionally introducing viruses, Trojan horses, worms, logic bombs, or other malicious or technologically harmful materials. You shall not attempt to gain unauthorized access to the services, the websites or mobile applications where the services are stored, or any servers, computers, or databases connected to the services. You shall not attack the services through a denial - of - service attack or a distributed denial - of - service attack. Violation of this provision shall constitute a criminal offense. We will report any such violations to the relevant law enforcement agencies and will cooperate with those agencies to disclose your identity to them. In the event of such a violation, your right to use the services will be terminated immediately.

Virtual Currency and Goods

The services may include virtual currency, such as coins, points or the like, which can be earned or obtained through the services, or purchased by you with legal tender or real currency, subject to applicable laws (such virtual currency, collectively, “virtual currency”). The services may also include virtual digital goods, such as assets, commodities, abilities or other goods, which can be earned or obtained through the services, or purchased by you with legal tender or real currency, or purchased by you with virtual currency, subject to applicable laws (such virtual goods, collectively, “virtual goods”).

StardustTV reserves the absolute right to manage, supervise, control, modify or eliminate virtual currency and/or virtual goods at any time in its sole discretion, and StardustTV shall not be liable for the exercise of such rights with respect to you or any third party. You shall have a limited, personal, revocable, non - transferable, non - sub - licensable license to use the virtual goods and virtual currency that you have earned, purchased or otherwise obtained in a manner authorized by StardustTV, only within the scope of the services. You have no other rights, title or interest in any such virtual goods or virtual currency that appears or is generated in the services.

You hereby acknowledge and agree that the transfer of virtual currency and virtual goods is strictly prohibited unless expressly authorized in the services. Outside of the services, you shall not sell, exchange or otherwise transfer virtual currency or virtual goods to StardustTV, any other user of the services or any other party.

You agree that all sales of virtual currency and virtual goods are final and non-refundable, except at the sole discretion of StardustTV. You acknowledge and agree that in the event of the termination of these Terms of Use, your account or the services for any reason, including if StardustTV discontinues the services or applicable parts of the services for any reason, you will forfeit all virtual currency and virtual goods, and StardustTV shall not be liable for the same.

Feedback and Suggestions

We welcome and appreciate your feedback and suggestions on how to improve our Services. You can submit your feedback and suggestions through our app or by contacting us. By submitting your feedback and suggestions, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such feedback and suggestions throughout the world in any media for any purpose without any compensation or notice to you.

Termination

(b) Deleting or otherwise destroying all materials related to the services;

Our Right to Terminate: StardustTV may terminate these Terms of Use, your account, and your access to the services (or applicable parts of the services as determined by StardustTV in its sole discretion) at any time for any reason. StardustTV may, in its sole option and at its absolute discretion, give you a warning or other notice prior to termination, for example, in the event of your violation of these Terms of Use. However, you acknowledge that StardustTV is not required to provide you with any such notice or warning prior to termination under this clause.

Account Deactivation or Termination: If your account has been inactive for one year or more, StardustTV may, in its sole discretion, deactivate or terminate your account. You further agree that upon deactivation or termination of your account, StardustTV may delete your content and information and will not return your content to you in any way. StardustTV will not be liable for any damage or consequences you may suffer as a result of the deletion of your content or information. It is entirely your responsibility to preserve any of your content. StardustTV will consider various factors to determine whether you are still accessing your account. These factors include the date of your last access.

Consequences of Breach of Terms: Additionally, if StardustTV suspects or determines that you may:

(i) Fail to comply with any provision of these Terms of Use or any policy or rule established by StardustTV; or

(ii) Engage in conduct in connection with or during the use of the services that may be illegal or that may cause liability, harm, embarrassment, harassment, abuse, or disruption to you, StardustTV, any third party, or the services themselves, StardustTV may notify the authorities or take any action it deems appropriate (including, but not limited to, suspending your account and your access to the services) without notifying you.

Consequences of Termination: As a result of termination, you may lose your account and all information and data associated with it, including, but not limited to, your username, profile picture, in-app roles and achievements, virtual currency, and virtual goods (if applicable).

You acknowledge and agree that in the event of any termination permitted under these Terms of Use for any reason (whether terminated by you or StardustTV), you will not be entitled to any refund, compensation, or other liability, and StardustTV will not be liable to you or any third party. If StardustTV terminates your account, you may not participate in the services or any other StardustTV services without the express written permission of StardustTV. To request permission to participate in StardustTV services after termination, submit a request via stardusttvapp@gmail.com. StardustTV reserves the right to deny an account to any individual and to provide its services to them. You may not allow an individual whose account has been terminated by StardustTV to use your account.

Limitation of Liability

To the fullest extent permitted by law, we and our affiliates, directors, officers, employees, agents, licensors, and partners will not be liable for any direct, indirect, incidental, consequential, special, exemplary, punitive, or other damages arising from or relating to your access or use of or inability to access or use our Services or content or any User Content or feedback and suggestions or any third-party websites or services linked to or from our Services or content. This limitation of liability applies regardless of the theory of liability (contract, tort, negligence, strict liability, or otherwise) and even if we have been advised of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of certain damages, so some or all of the above exclusions or limitations may not apply to you.

We reserve the right to change these Terms at any time and at our sole discretion. We will notify you of any changes by posting the updated Terms on our app or by sending you an email. Your continued access to and use of our Services after we post the updated Terms will constitute your acceptance of the changes. If you do not agree to the changes, you must stop accessing and using our Services.
